New Limits on Sale of Alcohol

Strict new laws restricting the sale and possession of alcohol came into force last week.

Under the provisions of the Intoxicating Liquor Act 2008, which came into effect at midnight on 30 July, off-licences and nightclubs must operate under earlier closing times. Off-licences must now close at 10pm.

Gardaí have also been given tougher public order powers to curb underage drinking.

  • Gardaí can seize alcohol from those under 18 years of age who are drinking in public.
  • Gardaí are permitted to seize bottles or containers containing alcohol where they believe there is a risk of public disorder or damage to property.
  • Gardaí can impose penalty fines for public drunkenness and disorderly behaviour.
  • Firmer penalties have also been introduced for retailers found selling alcohol to minors.

The Minister for Justice, Dermot Ahern, says the new law aims to tackle alcohol-related public order offences. “The Act places restriction on the availability and visibility of alcohol and provides for more effective enforcement to deal with the consequences of alcohol abuse.”

The Act also includes restrictions on alcohol promotions and the inclusion of alcohol in any loyalty card schemes.

Two further elements of the Act, addressing the separation of alcohol in supermarkets and convenience stores and the test-purchasing of alcohol by persons under 18, are to be introduced at a later date.
